1. Scope
These terms and conditions apply to all orders in the online shop of Misimi Skincare, sole proprietorship, owner Liridon Misimi, Waldaustrasse 17, 9000 St. Gallen, UID CHE-174.752.257, operated under the name LuminLab ("LuminLab"). Deviating terms of the customer only apply if LuminLab confirms them in writing. The shop is aimed at private individuals aged 18 and over with a delivery address in Switzerland, Germany or Austria.
2. Offer and conclusion of contract
The presentation of products in the shop is not a binding offer. By clicking "Pay now" you place a binding order. You will then receive an automatic confirmation of receipt by email. The contract is concluded with the shipping confirmation or the delivery. LuminLab may reject orders without giving reasons, for example in the event of supply shortages; any amounts already paid will then be refunded in full.
3. Prices
For deliveries to Switzerland, all prices are in Swiss francs (CHF). For deliveries to Germany and Austria, prices are shown and charged in euros (EUR). LuminLab is not subject to VAT; no VAT is shown. Shipping costs are shown separately during checkout. The price shown at checkout at the time of the order applies. In the event of obvious pricing errors, LuminLab reserves the right not to process the order.
Deliveries to Germany and Austria: The goods are imported from Switzerland into the EU. Import VAT, any customs duties and carrier fees may apply. These are not included in the price and are usually collected by the carrier on delivery.
4. Payment
Payment is made in advance using the payment methods shown at checkout. Processing is handled by Shopify Payments or the respective payment provider.
5. Delivery
LuminLab delivers to Switzerland, Germany and Austria. Delivery usually takes up to 14 days from receipt of payment. If this period is exceeded, you will receive, on request, a store credit for the order value or, if you prefer, a refund. If a product is not available, you will be informed and can cancel the order in whole or in part. The risk passes to you when the goods are handed over to the post or the shipping provider; for consumers in Germany and Austria, only when the goods are handed over to you.
6. Products and use
All products are original goods from the respective manufacturers. Please note the ingredients on the packaging and carry out a patch test before first use if you have sensitive skin. Stop using the product if skin irritation occurs. LuminLab is not liable for intolerances caused by individual allergies.
7. Returns and withdrawal
Customers resident in Switzerland: Purchased products are excluded from exchange and return. Under Swiss law there is no statutory right of withdrawal or return for online purchases. The warranty under section 8 remains reserved.
Consumers resident in Germany or Austria: You have a statutory right of withdrawal of 14 days. Details and the model withdrawal form can be found on the "Returns & Withdrawal" page. The right of withdrawal expires for sealed goods that are not suitable for return for health protection or hygiene reasons if their seal has been removed after delivery.
8. Warranty
Please check the goods on receipt. Report damaged, defective or incorrectly delivered products within 7 days of receipt by email to Luminlab@proton.me, if possible with a photo. LuminLab will, at its discretion, provide a replacement or refund the purchase price. The statutory warranty period is two years from delivery; for cosmetics, the best-before date or the period after opening also applies. For consumers in Germany and Austria, the statutory warranty rights of their country of residence apply; the 7-day notification period does not restrict them.
9. Liability
LuminLab is only liable for damages in cases of intent or gross negligence. Liability for slight negligence, indirect damages and consequential damages is excluded to the extent permitted by law. Mandatory liability provisions, for example under the Product Liability Act, remain reserved.

11. Changes
LuminLab may amend these terms at any time. The version valid at the time of your order applies.
12. Applicable law and place of jurisdiction
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers resident in Germany or Austria, the mandatory consumer protection provisions of their country of residence remain applicable. The place of jurisdiction is St. Gallen. The statutory place of jurisdiction at the consumer's place of residence remains reserved.
